TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and M Designs (Marco Hol), Groningen, Netherlands ("M Designs", "we", "us"), governing your use of:

• The website blitzlaststand.com and all its subpages
• The video game Blitz: Last Stand, including the browser demo, full game, and Electron desktop application
• Any related services, including the global leaderboard and newsletter

By using any of the above, you confirm that you are at least 13 years of age (or have parental consent if required by your country's laws) and that you accept these Terms in full.

2. THE GAME LICENCE

Subject to your compliance with these Terms, M Designs grants you a limited, personal, non-exclusive, non-transferable, revocable licence to:

• Play Blitz: Last Stand for personal, non-commercial entertainment purposes
• Access the browser demo and full game via blitzlaststand.com
• Install and run the Electron desktop application on your personal device

This licence does not transfer any ownership rights to you. You are purchasing or accessing a licence to play the game, not buying the game software itself.

What you may NOT do

• Copy, reproduce, redistribute, or make the game available for download outside the official platforms
• Reverse-engineer, decompile, disassemble, or extract the source code
• Modify, create derivative works, or build tools that interact with the game in unintended ways (cheats, bots, auto-clickers)
• Use the game for commercial purposes without prior written consent from M Designs
• Remove or alter any copyright notices, trademarks, or attribution in the game
• Sell, rent, lease, sublicense, or otherwise transfer the game or your licence to any third party

3. PURCHASES

Blitz: Last Stand is sold through Steam (Valve Corporation) and itch.io. All purchases are processed exclusively by these platforms under their own terms and conditions:

M Designs does not process payments and has no access to your payment information. For refund requests, billing disputes, or payment issues, contact Steam or itch.io directly via their respective support channels.

Refund Policy

Refunds are governed by the platform through which you made the purchase:

• Steam: Valve's standard refund policy applies — generally eligible within 14 days of purchase with fewer than 2 hours of playtime.
• itch.io: Purchases are generally non-refundable unless required by applicable law. EU consumers have a 14-day statutory withdrawal right for digital goods under the Consumer Rights Directive, unless download has begun with your explicit consent and waiver.

4. USER CONDUCT

When using the website, game, or leaderboard, you agree not to:

• Submit false, misleading, offensive, or illegal content — including via the leaderboard name field
• Use the leaderboard to submit real personal data (full name, email address, phone number) of yourself or others
• Use cheats, exploits, hacks, or third-party software to manipulate your score or the game state
• Attempt to attack, overload, or interfere with the website or server infrastructure
• Impersonate M Designs, the game, or other players
• Use the newsletter sign-up for any purpose other than receiving Blitz: Last Stand launch updates

M Designs reserves the right to remove any leaderboard entry or block access to the service for any user who violates these rules, without prior notice.

5. LEADERBOARD

The global leaderboard is a public feature of the game. By submitting a leaderboard entry, you acknowledge and agree that:

• Your chosen name and score will be publicly visible to all players worldwide
• You will not use your real full name, email, or other personal identifiers as your leaderboard name
• M Designs may remove any entry at its sole discretion, including entries that contain offensive, misleading, or inappropriate content
• Scores obtained through cheating or exploiting bugs may be removed without notice
• Leaderboard entries may be retained indefinitely as part of the game's public record

To request removal of your leaderboard entry, contact info@blitzlaststand.com.

6. INTELLECTUAL PROPERTY

All content on this website and within the game — including but not limited to source code, game mechanics, visual design, artwork, music, sound effects, text, trademarks, logos, and the "Blitz: Last Stand" name — is the exclusive intellectual property of M Designs, unless otherwise indicated.

Third-party assets used in the game are licensed under valid commercial licences (Pixabay Content Licence, Higgsfield AI commercial licence, SIL Open Font Licence). These licences do not grant you any rights to those assets independently of the game.

Community Content

Fan art, let's play videos, reviews, streams, and other non-commercial community content about Blitz: Last Stand are explicitly welcomed and encouraged. For commercial use of the game's branding or assets, contact info@blitzlaststand.com.

7. NEWSLETTER

By subscribing to the Blitz: Last Stand newsletter, you agree to:

• Receive periodic launch updates and game announcements from M Designs
• The processing of your email address as described in our Privacy Policy

You can unsubscribe at any time by clicking the unsubscribe link in any newsletter email, or by emailing info@blitzlaststand.com. Unsubscription will be processed within 5 business days.

8. GAME UPDATES & AVAILABILITY

M Designs may, at its sole discretion and without prior notice:

• Update, modify, or add features to the game
• Take the website or game offline for maintenance
• Discontinue the browser demo or full game at any time
• Update these Terms of Service

M Designs makes no guarantee of continuous, uninterrupted availability of the website, browser game, or leaderboard. Temporary unavailability does not constitute a breach of these Terms.

The Electron desktop application, once installed, functions independently and does not require an internet connection to play (except for leaderboard access).

9. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, M Designs disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

This disclaimer does not affect your statutory rights under Dutch or EU consumer protection law, which cannot be excluded by contract.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, M Designs shall not be liable for:

• Loss of saved game data, progress, or leaderboard entries (e.g. due to server issues, browser updates, or localStorage being cleared)
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the game or website
• Losses caused by third-party platforms (Steam, itch.io) or services beyond M Designs' control
• Incompatibility of the game with your device, browser, or operating system

Where limitation of liability is not permitted under Dutch or EU consumer law, liability is limited to the maximum extent the law allows. In no event shall M Designs' total liability exceed the amount you paid for the game.

11. THIRD-PARTY SERVICES

This website and game may link to or integrate with third-party services, including Steam, itch.io, and YouTube. M Designs is not responsible for the content, privacy practices, or terms of those services. Your use of third-party services is governed solely by their own terms.

12. TERMINATION

M Designs may terminate or suspend your access to the website, leaderboard, or newsletter at any time if you breach these Terms. Upon termination:

• Your licence to access the browser game and website ends immediately
• Your leaderboard entries may be removed
• Your newsletter subscription will be cancelled

Termination does not affect any licence granted through Steam or itch.io — those are governed by their respective platform terms.

13. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or your use of the game shall be subject to the exclusive jurisdiction of the competent courts in Groningen, Netherlands.

If you are a consumer in the European Union, you may also bring claims before the courts of your country of residence under applicable EU consumer protection rules.

EU consumers may use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

14. CHANGES TO THESE TERMS

M Designs reserves the right to update these Terms at any time. Material changes will be indicated by an updated date at the top of this page. Where required by law, newsletter subscribers will be notified of material changes.

Continued use of the website or game after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the website and game.
